13 With reference to your Despatch No. 312 of the 15th. of October last, I have the honour to transmit for your in- -formation copy of a letter which on my return to the Colony I caused to be addressed to Sir Kai Ho Kai intimating that it would not be possible to nominate him to a sent on the Legislative Council on the expiration of the present term of his appointment. In his reply, copy enclosed, Sir Kai informed

me that it was his intention owing to reasons of health not to accept a further appointment, and I apprised the Council of this fact at a Meeting held on the 25th. ultimo when I moved a resolut- -ion recording the Council's appreciation of Sir Kai's services in the past. I enclose a Hansard Report of the proceedings.

I also enclose copy of personal correspondence between myself and Sir Kai relating to this matter.

Sir Kai's loss will be felt in the Legislative Council where his acumen and knowledge were very useful factors in debate. I trust, however, that his health will per: it him to continue his public activities outside the Council and that the Government will still have the benefit of his advice and co-

-operation.
